Use of the site
Eligibility
By accessing or using jaiwinplay.in.net ("the Site"), you confirm that you are at least 18 years of age, have the legal capacity to enter into binding agreements under applicable Indian law, and agree to comply with these Terms of Service ("Terms") in full. If you do not meet these requirements, you must not use the Site. Jai Win reserves the right to verify your age and identity at any time and to suspend or terminate access where eligibility criteria are not satisfied.
Permitted use
You may access and use the Site solely for lawful purposes and in accordance with these Terms. You agree not to attempt unauthorised access to any portion of the Site or its servers, transmit spam or unsolicited promotional material, use automated bots or scrapers to collect data without our prior written consent, or engage in conduct that restricts another user's enjoyment of the Site. All use of the Site must comply with the Information Technology Act, 2000, the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and any other applicable Indian legislation in force at the time of access.
Account responsibilities
If you create an account on the Site, you are solely responsible for maintaining the confidentiality of your login credentials and for all activities carried out under your account. You must notify us immediately at [email protected] of any suspected unauthorised use. Jai Win will not be liable for any loss or damage arising from your failure to safeguard your account information. We reserve the right to disable any account at our sole discretion if we reasonably believe these Terms have been breached.
Intellectual property
Ownership
All content on the Site, including text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, is the property of Jai Win or its content suppliers and is protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and applicable international intellectual property treaties. Unauthorised reproduction or distribution of any Site content may give rise to civil and criminal liability under Indian law.
Limited licence
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Site for personal, non-commercial purposes only. This licence does not include the right to reproduce, distribute, publicly display, or create derivative works from any Site content, nor to use data-mining tools, bots, or similar technologies without our express written consent. Any use of Jai Win's trademarks, logos, or brand assets, including the name "Jai Win", without prior written approval is strictly prohibited.
User-submitted content
If you submit reviews, comments, or other content to the Site, you grant Jai Win a worldwide, royalty-free, perpetual, irrevocable, non-exclusive licence to use, reproduce, modify, publish, and distribute that content across any media. You warrant that you own or control all rights in such content and that it does not infringe any third-party intellectual property rights. Limitation of liability
No warranties
The Site and all content, products, and services made available through it are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Jai Win does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components, and accepts no responsibility for any losses arising from reliance on Site content.
Liability cap
To the maximum extent permitted by applicable Indian law, Jai Win, its directors, employees, agents, affiliates, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business opportunities, arising out of or in connection with your use of or inability to use the Site. Where liability cannot be fully excluded by law, our total aggregate liability to you shall not exceed the amount you paid, if any, to Jai Win in the three months immediately preceding the event giving rise to the claim.
Third-party services
The Site may contain links to third-party websites or integrate with third-party payment services such as PhonePe, Google Pay (GPay), or BHIM UPI. Jai Win does not endorse, control, or assume responsibility for the content, privacy practices, or reliability of any such third-party service. Any transactions you conduct through those platforms are governed solely by the terms and policies of those third parties, and Jai Win shall bear no liability for any loss, dispute, or failed transaction arising from their use.
